ICE Extends Form I-9 Compliance Flexibility Until Dec. 31, 2021

The U.S. Immigration and Customs Enforcement (ICE) on August 31, 2021 declared an extension of the flexibilities in rules related to Form I-9 compliance. On account of the continued safety measures related to COVID-19, the Department of Homeland Security (DHS) has decided to extend the flexibility that was initially granted in March 2020 until December 31, 2021.

The current extension will continue to apply the guidance previously issued for employees hired on or after April 1, 2021, and work exclusively in a remote setting due to COVID-19-related precautions. According to its guidance issued on March 2020, DHS stated that it would exercise prosecutorial discretion to defer the physical presence requirements associated with the Employment Eligibility Verification (Form I-9) under section 274A of the Immigration and Nationality Act.  It was mentioned that this policy solely applies to employers and workplaces that are operating remotely.  For those employees who were physically present at a work location, no exceptions were being implemented at that time for in-person verification of identity and employment eligibility documentation for Form I-9.
